Interim Measures for the Management of Mineral Resources Indexes

Chapter I General Provisions

Article 1 These Measures are formulated to strengthen the management of the country's total mining control minerals, prevent excessive exploitation of dominant mineral resources, and protect and rationally utilize mineral resources, in accordance with the mineral resources laws and regulations and the relevant provisions of the State Council.

Article 2 The minerals referred to in these Measures for the control of the total amount of mining, including the minerals controlled by the State Council in accordance with the requirements of the State Council, and the minerals controlled by the Ministry in accordance with relevant regulations.

The third department is responsible for determining the national annual total mining control indicators, and assigns them to the provincial land and resources authorities; the provincial land and resources authorities are responsible for the decomposing and supervising management of the total mining control indicators in the administrative areas; The competent department of land and resources is responsible for the supervision and management of the implementation of the total control indicators.

Chapter II Determination and Distribution of Indicators

The fourth section determines the annual mining total control indicators based on the national mineral resources planning and national industrial policies, taking into account mineral resources potential, market supply and demand, resource security, mining rights and capacity production.

The fifth part is equipped with the total annual mining total control indicators of each province (autonomous region, municipality), and the base number measurement algorithm or quantitative measurement algorithm may be used. Quantitative measurement algorithms should be implemented for qualified minerals.

Based on the mining total control indicators issued this year, the base number measurement algorithm combines mineral resources planning, national regional economic policies and related factors to determine the nuclear increase and deduction of the total mining control indicators.

The factors of nuclear increase mainly include: the national implementation of industrial layout adjustment needs to increase the index; the integration of mineral resources development is in place, the industrial concentration is obviously improved; the order of mineral development is stable, the implementation of the total indicator management system is strictly implemented; and other situations requiring nuclear addition .

The factors of nuclear reduction mainly include: the implementation of the indicator management responsibility is not implemented, the annual super-indicator production or the failure to report the implementation of the indicators; the mine safety accidents are frequent; the environmental damage is more serious; the unlawful mining, cross-border mining and other violations are not investigated in time. The mining rights are not paid for as required; and other circumstances that require a reduction.

The specific calculation formula and description of the quantitative measurement algorithm are shown in the annex.

Chapter III Release of Indicators

In the first quarter of each year, the Ministry of Land and Resources issued the total amount of mining control indicators for the provinces (autonomous regions and municipalities).

The total mining control indicator shall not be used across the year and shall be valid until December 31 of the current year.

Article 7 The competent department of land and resources at the provincial level shall report to the Ministry before the end of November each year the expected completion of the indicators for the current year, and submit the application for the next year's mining indicators, and explain the reasons for the increase and decrease.

Article 8 The competent department of land and resources at the provincial level shall refer to the implementation of the previous annual mining total control indicators of mining enterprises according to the retained resources reserves, development and utilization, and resource utilization levels of mining enterprises within their respective jurisdictions, and combine the municipal and county-level land resources. Chapter IV Indicator Management

Article 9 After the decomposition of the total amount of mining control indicators is issued, the mining enterprise shall sign a letter of responsibility with the competent land and resources department at the county level to clarify the rights, obligations and liabilities for breach of contract, and file with the provincial land and resources authorities. The style of responsibility book is formulated by the provincial land and resources authority.

Article 10 The implementation of the quarterly statistics system shall be implemented for the implementation of the total amount of mining control indicators. The mining enterprise shall submit the implementation of the total amount of mining control indicators to the competent county-level land and resources authorities in accordance with regulations; the competent land and resources department shall promptly report and report in accordance with the regulations. If the monthly statistical system is implemented, it shall be handled in accordance with relevant regulations.

Article 11 If the total amount of mining controlled minerals is associated with other minerals, it shall be included in the management of the total amount of mining control indicators, and shall not exceed the production of indicators. If the main mining species is in short supply of minerals in the country, it shall be subject to reserve and shall not be sold if it is approved by the competent department of land and resources at the provincial level.

Article 12 Mining enterprises shall establish a management system related to the total reserves of controlled mineral resources, production, sales of original ledgers and total mining control.

Article 13 The competent department of land and resources at the county level shall, through verification of statistical statements, production ledgers, consumption of resources, sales and taxation bills, strengthen the supervision and inspection of the implementation of the total mining control indicators in the administrative region, and shall follow the letter of responsibility. Relevant requirements, for mining enterprises that produce super-indicators, deduct the total amount of mining control indicators for the current year or next year, and investigate the mine company's liability for breach of contract.

Article 14 The Ministry of Customs conducts verification of the implementation of indicators in various places and reports on the implementation of annual indicators. If the provinces (autonomous regions and municipalities) with serious super-index mining are ordered to carry out rectification and rectification is unqualified, the province's (regional, municipal) next year's total mining control indicators shall be deducted, and the province (region, city) super-index mining shall be suspended. Chapter V Supplementary Provisions

Article 15 The competent department of land and resources at the provincial level may, in light of local actual conditions, formulate specific implementation measures in accordance with these Measures.

Article 16 The Ministry is responsible for the interpretation of these Measures and is valid for five years.

Article 17 These Measures shall be implemented as of the date of promulgation.
