Agricultural product packaging and label management methods

Chapter 1 General Provisions

Article 1 These regulations are formulated in accordance with the "Law of the People's Republic of China on Quality and Safety of Agricultural Products." Article 1 regulates the production and operation of agricultural products, strengthens the management of agricultural product packaging and labels, establishes and improves the traceability system for agricultural products, and guarantees the quality and safety of agricultural products.

Article 2 The packaging and labeling activities of agricultural products shall comply with the provisions of these Measures.

Article 3 The Ministry of Agriculture is responsible for the supervision and administration of agricultural product packaging and labeling throughout the country.

The agricultural administrative department of the local people's government at or above the county level shall be responsible for the supervision and administration of agricultural product packaging and labelling within its administrative area.

Article 4 The State supports scientific research on agricultural product packaging and labeling, promotes scientific packaging methods, and promotes advanced labeling technologies.

Article 5 The agricultural administrative department of the people's government at or above the county level shall incorporate the funds for agricultural product packaging and labeling management into the annual budget.

Article 6 The agricultural administrative department of the people's government at or above the county level shall commend and reward the units and individuals that have made outstanding contributions to the packaging and labeling of agricultural products.

Chapter II Agricultural Product Packaging

Article 7 Agricultural products production enterprises, farmers' specialized cooperative economic organizations, and units or individuals engaged in the acquisition of agricultural products, the following agricultural products for sale must be packaged:

(1) Acquiring certified agricultural products such as pollution-free agricultural products, green food, and organic agricultural products, except for fresh live animals, poultry, and aquatic products.

(2) Other agricultural products that require packaging and sales as stipulated by the agricultural administrative department of the people's government at or above the provincial level.

If the agricultural products that conform to the stipulated packaging are directly sold to consumers after unpacking, they may no longer be packaged separately.

Article 8 The packaging of agricultural products shall meet the requirements for storage, transportation, sales, and security of agricultural products, and be easy to disassemble and carry.

Article 9 The materials of packaged agricultural products and the used preservatives, preservatives, additives and other substances must meet the requirements of the national mandatory technical specifications.

Packaging agricultural products should prevent mechanical damage and secondary pollution.

Chapter III Identification of Agricultural Products

Article 10 Agricultural product production enterprises, peasants' specialized cooperative economic organizations, and agricultural products packaged and sold by units or individuals engaged in the acquisition of agricultural products shall mark or mark the packaged goods with the name, place of production, name of producer or seller, and date of production.

Where there are grading standards or the use of additives, the product quality grade or additive name shall also be indicated.

Unpackaged agricultural products shall be marked in the form of additional labels, identification plates, identification tapes, manuals, etc. to indicate the names, production sites, names of producers or sellers of agricultural products, etc.

Article 11 The words used for the identification of agricultural products shall use standardized Chinese. The content of the labeling should be accurate, clear, and prominent.

Article 12 Agricultural products that have been sold to obtain the right to use quality marks such as pollution-free agricultural products, green food, and organic agricultural products shall be marked with corresponding signs and issuing agencies.

It is forbidden to use quality marks such as pollution-free agricultural products, green food, and organic agricultural products.

Article 13 Livestock and poultry and their products, and agricultural products belonging to agricultural genetically modified organisms shall also be marked in accordance with relevant regulations.

Chapter IV Supervision and Inspection

Article 14 Agricultural product manufacturing enterprises, farmers' specialized cooperative economic organizations, and units or individuals engaged in the acquisition of agricultural products shall be responsible for the packaging quality and labeling content of the agricultural products they sell.

Article 15 The administrative department of agriculture of the people's government at or above the county level shall supervise and inspect the packaging and labeling of agricultural products in accordance with the Law of the People's Republic of China on the Quality and Safety of Agricultural Products.

Article 16 Under any of the following circumstances, the agricultural administrative department of the people's government at or above the county level shall, in accordance with the "PRC Quality and Safety of Agricultural Products," articles 48, 49, 51, and 52 The provisions of the article deal with punishment:

(1) The agricultural product packaging materials used do not meet the mandatory technical specifications;

(2) Preservatives, preservatives, additives and other materials used in the packaging of agricultural products do not meet the mandatory technical specifications;

(3) Agricultural products that should be packaged are not sold by packaging;

(4) to use quality signs such as pollution-free agricultural products and green food;

(5) The agricultural products are not marked according to the regulations.

Chapter 5 Supplementary Provisions

Article 17 The meaning of the following terms in these Measures:

(1) Agricultural product packaging: refers to the practice of packing, boxing, bagging, wrapping, and bundling agricultural products.

(b) Preservatives: These are synthetic chemical substances or natural substances that maintain the freshness of agricultural products, reduce circulation losses, and extend storage time.

(3) Preservatives: It refers to synthetic chemical substances or natural substances that prevent the deterioration of agricultural products.

(4) Additives: Synthetic chemical substances or natural substances added to improve the quality and color, aroma, taste and processing performance of agricultural products.

(5) Production date: Plant products refer to the date of harvest; livestock and poultry products refer to slaughter or output dates; aquatic products refer to the date of arrest; and other products refer to the date of packaging or sales.

Article 18 These Measures shall come into force on November 1, 2006.
